Security agents are now investigating the source of alleged forged security reports on the April 2007 governorship election in Ondo State which formed the basis of the Election Tribunal’s decision on the polls. The tribunal reversed INEC’s declaration of Dr. Olusegun Agagu as the winner of that election and proclaimed Dr. Olusegun Mimiko victorious.
The Court of Appeal, sitting in Benin affirmed the tribunal’s decision.
But in a May 10, 2010 petition to President Goodluck Jonathan, Dr. Agagu faulted the decision of both courts which he said were based “on the acceptance by the judges that the elections in 10 LGAs where PDP won were marred with irregularities and violence and therefore cancelled over 63% of votes cast in three LGAs while they returned all the votes in the 7 LGAs where Labour Party wonâ€.
He said in both judgements, “the decision of the judges was substantially based on the fake security reports purportedly written by SSS which flawed the elections only in the local government areas where I wonâ€.
Continuing, he said, “it must be emphasised that our lawyers objected to the admission of these purported SSS reports, especially since the SSS officer subpoenaed stated clearly in the open tribunal that the Department of State Security Service did not have such reports.
“In spite of this, the judges still laid credence on the fake reports stating that the court is not concerned with how the evidence was obtained.
“It is under this legal infamy that some people are taking cover to do harm to our democracy by subverting the people’s mandate through our honourable but unsubstantiated jury.
Agagu said while he has accepted the outcome of the case as the will of God, he feels strongly that “the perpetrators of this forgery should not be left untouched as this will not only offend national justice but will constitute a looming danger to our democracy.
“If this trend of forgery is not arrested now by bringing the perpetrators to book through investigation at the highest levels possible, it portends serious dangers to the integrity of the actual results in our future elections and the formal beneficiaries by way of perverted justice using fake documentary evidence.â€
Security agents have already quizzed several people in connection with the allegation.
One of those quizzed is the chairman of a state government parastatal.
The alleged forged security reports listed electoral offences perpetrated mainly by the PDP during the election.
