Impeachment: Imo House writes Chief Judge as Agbaso goes to court

By CHIDI NKWOPARA, Owerri
The last may not have been heard as the Speaker, Imo State House of Assembly, Mr. Benjamin Uwajimogu, has sent a mail, IHA/CL/S.14/IV/577, to the State Chief Judge, Hon. Justice Benjamin Ahanonu Njemanze, to constitute a panel that would probe the alleged sins of the embattled Deputy Governor, Sir Jude Agbaso.

The letter reads: “May I request Your Lordship, pursuant to Section 188(5) of the 1999 Costitution (as amended), to constitute the panel members to investigate the allegations as contained in the article of misconduct attached to the notice of impeachment served on His Excellency, Sir Jude Agbaso, the Deputy Governor of Imo State.

“The request arose from the fact that the motion to do this investigation was passed in the plenary sitting (of) Wednesday March 13, 2013, by 25 out of 27 members, which is more than 2/3 as provided in Section 188 (4) of the 1999 Constitution of the Federal Republic of Nigeria as amended”.

The Speaker equally attached other documents, including notice of commencement of impeachment processes forwarding a petition signed by one third of the lawmakers, particulars of his misconduct, report of the House Special Ad-Hoc Committee and list of members that supported the motion for investigation of the allegations.

Meanwhile, Sir Agbaso has dragged the House to Federal High Court sitting in Owerri, seeking to stop his impending impeachment by the Assemblymen.

Registered as suit number FHC/OW/174/2013, Agbaso mentioned “lack of fair hearing” in the Chief Simeon Iwunze’s House Special Ad-Hoc Committee that investigated the remote causes, stoppage/abandonment of works on some roads in Owerri, Orlu and Okigwe towns.

He equally urged the court to order the suspension of impeachment proceedings initiated by the House of Assembly against him, until the determination of the matter.
