BENIN—THE High Court in Benin will on November 15, hear the contempt case filed by the people of Oghede Community of Ovia North-East Local Government Area of Edo State, against the Commanding Officer of 322 Artillery Regiment of the Nigerian Army, Ekenwa Barracks, Benin City.

Also in the suit is the Master Warrant Officer of the Regiment.

It will be recalled that the High Court in Benin had, on October 13, 2011, given an order of interlocutory injunction restraining the Nigerian Army or its privies from further invasion of  Oghede community, following a suit filed against the Army by the Enogie of Oghede, HRH Osadebamwen Aghahowa, over a disputed land.

The Army and the community have been embroiled in a protracted land dispute.

However, in form 48 filed by its counsel, Evbayiro Lawson, the community complained that despite the injunction by the High Court restraining the Army from further invasion of the community, the Army, on October 6, 2012, invaded the community, destroying houses built by indigenes of the community.

The community prayed the court to imprison the Army officers in charge of the Regiment for alleged disobedience of  its order.
