WARRI—A Delta State High Court sitting at Effurun has restrained the Chairman and Managing Director of Chevron Nigeria Limited, CNL, Mr. Andrew Fawthrop and three others, from breaching a contract entered into with Woodridge Hotels Limited, Effurun, Delta State.
Woodridge Hotels is owned by the Minister of State for Education, Chief Kenneth Gbagi.
Ruling on an ex-parte application by the applicant, trial judge in the matter, Justice G. Gbemre ordered Mr.
Fawtgrop, Chevron, Escravos Gas Limited and Southern Gas Constructions Limited to abide by the terms of the contract pending the determination of the suit.
Woodridge had sought for an interim order, restraining the defendants whether by themselves, from breaching the contract between the parties which was for a fixed term up to May 2011 by evacuating from the hotel and removing their equipment and property in breach of the contract, pending the determination of the suit. Ruling on the application, Justice Gbemre said the court was convinced of the urgency of granting the application.
“I have read the motion paper, affidavits and annexures and I am convinced that there is real urgency warranting my intervention in granting this application. The defendants are to be put on notice and the return date for the motion on notice is 27/9/2010.”
