The National Chairman of the Action Alliance ,AA, Chief Kenneth Udeze, has applauded the decision of the Court of Appeal sitting in Akure for granting his application to withdraw as an interested party in a suit challenging the leadership of the party.

Udeze, through Motion Nos. CA/AK/268M/2025 and CA/AK/309M/2025, sought the leave of the Court of Appeal to withdraw as an interested party in the matter.

He maintained that the issues raised in the appeal had already been conclusively determined by courts of competent jurisdiction in favour of his leadership of the party.

According to him, the judgment of the Federal High Court, Osogbo Division, in Suit No. FHC/OS/CS/34/2025, which formed the basis for the appeal, was delivered on September 29, 2025, despite the existence of several subsisting judgments of the Court of Appeal affirming Chief Barr. Kenneth Udeze as the authentic National Chairman of the Action Alliance.

He argued that the numerous Court of Appeal judgments recognising his leadership are binding and superior to the decision of the lower court, stressing that they constitute compelling legal authority on the matter.

Udeze further stated that the appellate court’s judgments remain valid and cannot be set aside by a lower court, particularly in view of the pending appeal before the Supreme Court in Appeal No.SC/CV/162/2024 between Adekunle Rufai Omoaje & Others v. Chief Uzewuru Nwachukwu & Others.

He noted that the Court of Appeal, Abuja Division, in its judgment delivered on January 26, 2024, among other decisions, affirmed and recognised him as the authentic and lawful National Chairman of the Action Alliance, adding that those judgments remain binding until set aside by the Supreme Court.
