Surety turns accused for alleged failure to produce suspect

A 34-year-old surety, Emmanuel Obijekwu, who allegedly failed to produce a suspect on bail at the police station, was on Tuesday charged before an Igbosere Magistrates’ Court in Lagos.

The accused, who resides at No. 3, Ore-Ofe St., Okokomaiko, on the outskirts of Lagos, is facing a two-count charge of conspiracy and intent to pervert the course of justice.

The prosecutor, SP Eshiet Eshiet told the court that the accused committed the offences on March 3 at about 2. 30 p.m. at Zone 2, Police Station, Onikan, Lagos.

He said the accused stood as a surety for Philomena Nwaonumah, who is facing a two-count charge of conspiracy and fraud.

Eshiet said that the accused promised to produce the suspect any time he was needed by the police but failed to do so.

“My Lord, I want the accused to show cause why the N10 million bail bond he entered into as a surety should not be forfeited to the Lagos State Government.’’

The offences contravened Sections 97 (1) and 132 of the Criminal Law of Lagos State, 2011.

The accused, however, pleaded not guilty to the charge.

Magistrate Folashade Botoku granted the accused bail in the sum of N5 million with two sureties in like sum.

She said the sureties should show evidence of tax payment to Lagos State Government as part of the bail condition.

The case was adjourned until April 10 for mention.
