The advice by the Deputy Director, DPP, Mr. Adegboyega Bajulaye, read: “I am directed to acknowledge receipt of your letter, reference no: CB/3960/LS/XS/D4?vol.1/53 dated March 1, 2013 and the accompanying duplicate case file forwarded to this office for legal advice.

“After careful consideration of the facts contained in the duplicate case file, it is the opinion of this office that there is no prima facie case established against the suspects, Femi Bakare (m), Toyin Eleku (f), Kamoli Eleku (m), Segun Eleku (m), Tajudeen Eleku (m), Akeem Otunla (m) and Shamsudeem Otunla (m).

“Fact in the duplicate case file reveals that there are allegation and counter-allegation of crime by the complainant, HRM Elemoro and the suspects, all which flows from the dispute between the parties relating to the ownership of land.

“Parties should, however, be advised to maintain the peace and obey the order of the High Court.

“In the light of the above, this office hereby, recommends non prosecution of the suspects.”
