A local businessman, identified simply as Joseph, has been sentenced to ten years in prison by the Benin High Court, following his conviction for engaging in same-sex activities during his birthday celebration earlier in February at RAVE Night Club in Benin City, Edo State.

The sentencing follows a high-profile police raid on February 18, 2023, conducted by the Edo State Police Command, Adesuwa Division, which disrupted what authorities reportedly described as an illicit gathering involving “indecent same-sex activities” in violation of Nigeria’s Same-Sex Marriage (Prohibition) Act of 2014.

The ruling marks a significant enforcement of Nigeria’s stringent anti-LGBTQ laws, which prohibit same-sex relationships and carry penalties of up to 14 years imprisonment.

Joseph, the key figure behind the event, was among eight individuals—six men and two women—arrested during the raid. The prosecution presented compelling evidence, including CCTV footage from the nightclub and witness statements, which captured Joseph and others, including Edem Peter Otuekpo, in compromising acts.

The Police hailed the verdict as a triumph for law enforcement’s commitment to upholding Nigeria’s legal framework, saying: “The evidence was irrefutable, and the court’s decision sends a clear message that violations of the Same-Sex Marriage Prohibition Act will not be tolerated.”

Court documents revealed that one of the arrested individuals provided statements implicating Joseph and others, strengthening the prosecution’s case. While Edem Peter Otuekpo, also implicated in the CCTV footage, remains at large after failing to honour police invitations, authorities have vowed to continue their pursuit of all suspects involved.

The case has further intensified debates over Nigeria’s anti-LGBTQ legislation, with activists warning of escalating discrimination and violence against the LGBTQ community.
