The Federal High Court sitting in Sokoto yesterday adjourned a case of perjury preferred against a member of House of Representative elected under the Peoples Democratic Party, PDP to represent Kamba/Dandi Federal Constituency in Kebbi State, Alhaji Ibrahim Bawa Kamba and the Independent National Electoral Commission, INEC by Alhaji Hussaini Suleiman Kangiwa of the Congress for Progressive Change, CPC.
Alhaji Hussaini Suleiman Kangiwa had approached the Federal High Court suing Alhaji Ibrahim Bawa Kamba as the First Defendant and the Independent National Electoral Commission, INEC as the Second Defendant claiming “that the 1st defendant gave the 2nd defendant false information in the form CF 001 submitted by him for the purposes of contesting election into the House of Representatives as a member representing AREWA/DANDI Federal Constituency in Kebbi state for the April 2011 House of Representatives election.”
At the hearing of the matter Friday, Counsel to the 1stDefendant/Applicant, Yakubu C. Maikyau, Esq. moved an application brought pursuant to Order 48 Rule 4 of the Federal High Court (Civil Procedure) Rules, 2009 for leave of Court to extend “time within which the 1stDefendant would file his Memorandum of Conditional Appearance, Witness Statement on Oath, List of Witness and List of Documents.”
On the other hand, Counsel to INEC, A. D. Auta had filed a Notice of
Preliminary Objection with a question for determination as to “whether this
Court can embark on the explanation of qualification or disqualification of
a party to contest an election which has already taken place,” especially
taking Section 2 (a) of the Public Officers Protection Act, Cap 372 Laws of
the Federation 1990.
