LAGOS – A Federal High Court sitting in Ikeja, Lagos, yesterday, declared a member of the House of Representatives, Ganiyu Olukolu, winner of the last primaries of the Action Congress of Nigeria, ACN, to replace Mrs. Susan Olley, chosen by the ruling party for tomorrow’s legislative election.
The ACN had in its January 12, 2011 primaries elected Olley as its candidate to represent the party in the House of Representatives for Amuwo-Odofin Federal Constituency of Lagos State, instead of the incumbent who also contested for the office.
Justice Stephen Adah, held that Olukolu was the winner of the primaries and ordered both INEC and the ACN to recognise Olukolu as the legitimate candidate of the party for the election.
Olukolu, a sitting member of the House of Representatives had approached Justice B.B. Aliyu of an Abuja Federal High Court, challenging the submission of the name of Mrs. Susan Olley as the winner of the primaries by the ACN.
He had joined the ACN and INEC as defendants in the suit before the case was transferred to the Lagos Judicial Division.
The judge held that the claimant won the primaries conducted by the party for the constituency on January 12, after scoring the highest number of votes.
