ASABA – A lawyer, Jeffrey Pere Oromoni, has dragged the Independent National Electoral Commission (INEC) and 10 political parties to court, challenging legality of ongoing and planned electoral activities in Warri Federal Constituency, Delta State

In the originating summons on SUIT NO: FHC/ABJ/CS/790/2026 filed before the Federal High Court Holden in Abuja, Oromoni, the Plaintiff contends that INEC has failed to comply with a binding judgment of the Supreme Court which ordered proper delineation of wards and polling units in Warri North, Warri South, and Warri South-West Local Government Areas.

The suit asks the High Court to determine whether INEC and political parties can lawfully proceed with electoral activities, including party primaries and general elections, in absence of compliance with the Supreme Court’s directive in Hon. George Timinimi & Ors Vs INEC.

Specifically, the plaintiff seeks declarations that, “INEC is legally bound to obey the Supreme Court judgment;
Any electoral process conducted without compliance is unlawful. That Political parties cannot validly participate in such processes.”

Plaintiff also seeks orders compelling INEC to carry out the required delineation exercise, restraining both INEC and political parties from conducting or participating in any electoral activities in the Warri Federal Constituency until full compliance with the Supreme Court’s judgment is met.

The suit further asks the court to invalidate any outcome arising from electoral activities conducted in violation of the said judgment.

Oromoni maintains that failure to enforce the Supreme Court’s decision would undermine the Constitution and the rule of law.
