Osogbo—An Osun State High Court sitting in Osogbo has fixed hearing of a suit filed by Justice Folahanmi Oloyede against the state House of Assembly for next Thursday, September 3, 2015.

Justice Oloyede had filed a motion ex-parte asking the court to grant her permission to institute a legal action against the state lawmakers over their recommendation calling for her sanction by the state’s Judicial Commission NJC.

The serving judge had sent a petition to the state assembly leveling various allegations of financial misconducts against the state governor, Mr. Rauf Aregbesola and his deputy, Mrs. Grace Titi Laoye-Tomori.

Besides, the judge called on the assemblymen to examine and investigate the governor and his deputy over those allegations upon which the Speaker, Hon. Najeem Salam set up a seven-man ad-hoc fact-finding committee.

The committee however gave the governor a clean bill of health but recommended that Justice Oloyede be sanctioned for her alleged refusal to back up her allegations with evidence.

But ruling over the application filed on her behalf by Mr. Lekan Ogunlesi (SAN), the presiding vacation judge, Justice Adeyinka Aderibigbe granted all the five prayers sought by the applicant and ordered that the 11 respondents listed be served while adjourning the case till September 3.

Justice Oloyede approached the court asking that the said recommendations of the ad-hoc committee be quashed and that their actions be declared illegal, unconstitutional and null and void.

Filling the application of the motion on notice yesterday, Barrister Lukman Ogunseitan who held brief for Ogunlesi stated that his client was ready to challenge the “illegality” of the action of the House of Assembly.

Those joined in the suit as respondents included Hon Salam, the Chairman of the committee, Hon. Adegboye Akintunde and six other members of the committee, the clerk of the House of Assembly and the state Judicial Service Commission.
