Court revokes bail, ordered accused remanded in custody
Lagos – The Court of Appeal sitting in Lagos, on Tuesday, fixed Oct. 27 for the hearing of  the main appeal filed by business mogul,  Alhaji Aliko Dangote,  against a judgment of the Federal High Court.

Justice Lambo Akanbi of the Federal High Court, Lagos, had declared as void the election of Dangote as the President of the Nigerian Stock Exchange.

Akanbi had in his ruling held that the election held on Aug. 6, 2010 was unlawful.

He said that it was in violation of an order of the court which directed that the status quo be maintained pending the determination of some pending applications.

The judge had said that the decision to declare the election void was informed by the need to safeguard the integrity of the court.

The ruling was sequel to an application filed by some shareholders of the African Petroleum challenging the legitimacy of the election which was held despite the court’s order.

At the resumed hearing of the case, the court refused to entertain a motion filed by the appellant seeking for an order for the stay of proceedings in the lower court.

Also  An Abuja Senior Magistrates’ Court, sitting in Karu on Wednesday revoked the bail granted to a security guard, for refusing to appear in court for his trial.

The accused, Ezekiel Dogora, was also ordered to be remanded in prison custody.

Police Prosecutor, Sgt. Steven Imogha told the court that the accused with one Benson Garba were both charged for an alleged offence of joint act and house-breaking.

Imogha said the accused on Aug.17, 2010 formed common intention and broke through the burglary window of House 92, Prince and Princess Estate belonging to one Kayode Oduan.

He told the court that the accused stole 48 inches flat television screen, DVD player, multimedia sound system and four Hifi speakers.

The  accused had been standing trial for the alleged offence since 2010.

Also it was learnt that the accused pleaded not guilty before the court and was granted bail in the sum of N50,000 with a reasonable surety in like sum.

However, when the case came up for hearing, the prosecutor told the court that Dogora was issued a bench warrant on March 1 but had since not appeared for his trial.

Senior Magistrate Celestine Oba, however, said that Dogora had not appeared before the court for three consecutive times until a bench warrant was issued against him.

Odo said he had also not shown the court any genuine reason why he should absent himself for trail.

“The bail of the accused is, therefore, revoked and he should be transferred to prison custody for failure to appear before the court,’’ Odo ordered.

The case was adjourned till June 13 for continuation of hearing. (NAN)
