A Federal High Court sitting in Lagos, Tuesday, dismissed an application by the National Association of Nigerian Footballers (NANF) seeking to re-list a case against the Executive Committee of the Nigeria Football Federation which was earlier struck out based on a notice of discontinuance voluntarily filed by the same NANF.
The Federal High Court, Ikoyi presided over by Justice Okon Abang held that there was no provision in the Federal High Court Rules 2009 that allows a suit that was struck out based on a notice of discontinuance to be re-listed.
On the basis of this, the court dismissed the plaintiff’s motion of notice to re-list the suit. In this circumstance, the matter has come to a dead end.
It would be recalled that the NANF had on 7th January, 2011 filed a motion to re-list the case that it had voluntarily withdrawn before the Federal High Court.
