BENIN – A SENIOR lecturer and Chairman of the Medical Advisory Committee, CMAC, of the Delta State University Teaching Hospital, DESUTH, Oghara, Dr. Lawrence Omo-Aghoja, has instituted a suit  against the Chairman, Governing Council, of the hospital, Prof. Joseph Otubu and four others, over his alleged unlawful arrest and  detention at the AIG Zone 5 office,  Benin, Edo State.

Other  defendants in the suit before the Federal High Court, Benin, are Monday Akpodinyo, Inspector Okafor Christopher and the Assistant Inspector General of Police, Zone 5, Benin City.

Omo-Aghoja in the fundamental human rights enforcement suit, is asking the court to declare that his arrest and detention on February 22, 2011 from 7.00am to  3.00pm by the defendants in their office at Adesuwa Grammar School Road, Benin, was illegal, unlawful and unconstitutional.

The plaintiff is contending that he did not committed any offence to warrant his illegal arrest and detention, insisting  that the action of the defendants constituted a grave violation of his rights to liberty and freedom of movement as guaranteed by Article 6 and 12 of the African Charter on Human and Peoples Rights and Section 34(1) and 35(1) of the 1999 Constitution.
