US-based activist and academic, Prof. Sandra Chidinma Duru, also known as Prof. Mgbeke, has clarified reports concerning a recent court proceeding, stating that no order was issued restraining her from speaking publicly or directing the removal of her social media posts.
Prof. Duru made the clarification while responding to media reports following an interlocutory application in a suit instituted by the Senator representing Kogi Central, Senator Natasha Akpoti-Uduaghan, before a Federal High Court sitting in the Federal Capital Territory (FCT).
According to her, the court did not issue any order barring her from speaking, responding, or addressing issues relating to herself or the senator. She also stated that no relief was granted directing Meta Platforms Inc., operators of Facebook, or any other platform to delete her posts.
Prof. Duru explained that the ruling reaffirmed established legal principles, including the right of individuals to clarify issues concerning their reputation and to respond to matters affecting them within the bounds of the law. She noted that the court proceedings did not limit her ability to present factual information or address issues concerning her person.
She further stated that she remains entitled under the law to clarify her position, respond to public narratives about her, and place relevant facts on record where necessary.
“Defamation has a clear legal meaning and does not apply to factual statements or lawful responses made in defence of one’s reputation,” she said.
Prof. Duru urged members of the public to rely on verified court records and primary sources for accurate information regarding the matter.
She reiterated that she is exercising her right to clarify the record and respond to issues concerning her, adding that factual information shared for the purpose of self-defence does not amount to defamation under the law.
She concluded by stating that facts remain facts and should be understood as such within legal and public discourse.
