The National Secretary of the Action Alliance (AA), Vernimbe James, has said the party’s leadership under Chief Kenneth Udeze remains valid and legally recognised, insisting that fresh motions before the Akure Division of the Court of Appeal serve no practical purpose.
James,in a statement in Abuja on Tuesday,said the court is expected to hear an application by the Udeze-led leadership seeking the withdrawal of Motion No: CA/AK/268M/2025 and Motion No: CA/AK/309M/2025 on the grounds that the issues raised have already been settled by superior court judgments.
He noted that although a Federal High Court sitting in Osogbo delivered judgment on September 29, 2025 in Suit No: FHC/OS/CS/34/2025 in favour of Chief Adekunle Rufai Omoaje, there are several existing judgments of the Court of Appeal affirming Chief Kenneth Udeze as the authentic National Chairman of the party.
According to him, members of the public and the media are fully aware that there is still a pending appeal before the Supreme Court in Appeal No: SC/CV/162/2024 between Adekunle Rufai Omoaje and others versus Chief Uzewuru Nwachukwu and others.
James stressed that the appeal is against the judgment of the Court of Appeal, Abuja Division, delivered on January 26, 2024, which recognised Udeze as the lawful National Chairman of the Action Alliance.
“The Federal High Court judgment delivered in Osogbo on September 29, 2025 cannot, by the hierarchy of courts, overturn the valid and subsisting judgments of the Court of Appeal delivered on January 26, 2024 and other related decisions recognising Chief Kenneth Udeze as the authentic and lawful National Chairman of Action Alliance,” he said.
He maintained that the judgments of the Court of Appeal remain binding on all persons and authorities in Nigeria pending any contrary decision by the Supreme Court.
