OWERRI – A Federal High Court sitting in Owerri, Imo State, has thrown out the suit filed by Prince Bob Kay Njemanze seeking to restrain the state government from obtaining funds from the capital market for the execution of projects.

Justice L. Akanbi said he threw out the case because the plaintiff was unable to diligently prosecute his case.
Vanguard recalls that in requesting for adjournment, the plaintiff’s counsel pleaded with the court to give more time to retrieve the case file from the former counsel in Abuja.

This oral application was stoutly opposed by counsel to the first and second defendants who reminded the court that the matter had been adjourned several times at the instance of the plaintiff.

He further argued that the matter should not be allowed to last forever, stressing that there must be an end to any issue, especially as it would not be fair to stall government activities because of a single matter which lacked diligent prosecution.

In his ruling, Hon. Justice Akanbi said he agreed with the submissions of the defence counsel and subsequently overruled the application of the plaintiff.

The Judge said the plaintiff could not continue to hide under the pretence of trying to retrieve the case file and prolong the matter.

He, consequently, struck out the case.
