Court affirms Andy Uba’s candidacy

By IKECHUKWU NNOCHIRI

ABUJA – A Federal High Court in Abuja, yesterday, cleared Andy Uba to participate in the National Assembly elections holding in Anambra State tomorrow.

The court affirmed his candidacy after it dismissed a suit filed before it by one Anthony Nwadike seeking to invalidate his nomination alongside that of other nominees of the PDP in Anambra State for the National and state Houses of Assembly election.

The plaintiff had sought an order of court recognizing only candidates who emerged from the senator Waku led PDP electoral screening panel.

In his judgment yesterday, Justice Abdul Kafarati dismissed the suit on grounds that the issues raised were similar to ones in a similar pending before a high court in Anambra State.

The judge described the present case as an abuse of court process and subsequently dismissed it, after he had faulted the mode in which the suit was commenced, which was through an application for a judicial review.
