A CHIEFTAIN of the Peoples Democratic Party, PDP, in Adamawa State, Alh Sadiq Aliyu Jada, has sued the party and its National Chairman, Chief Okwesilieze Nwodo before an Abuja High Court in Maitama over the waiver granted former Vice President Atiku Abubakar to contest the parties presidential primaries.

Insisting that the waiver was illegal, the plaintiff maintained that the National Working Committee of the party bye_passed due process to re_admit Atiku into the party and urged the court for an injunction restraining Atiku from parading or holding himself out as a validly registered member of the PDP or it’s presidential aspirant.

Specifically, Jada is seeking “a declaration that the waiver for readmission to stand for election purportedly granted or given to the 4th Defendant, Atiku, by the National Working Committee and/or the National Executive Committee of the 1st Defendant, PDP, is in breach and violation of the PDP constitution having failed to follow due process and/or meet up the conditions precedent stipulated by Article 10 (b) (iii) of the said constitution and therefore null and void ab_initio, and has no effect whatsoever and therefore does not avail the 4th Defendant, Atiku, eligibility to contest or stand for election for the office of the president of the Federal Republic of Nigeria or any election whatsoever on the platform of the 1st Defendant.

“A declaration that the 4th Defendant, Atiku, herein is not a validly registered member of the PDP and therefore is not entitled to any rights, privileges accorded to registered members of the 1st Defendant”
Consequently, he has sought “an order of injunction restraining the Defendants by themselves, their organs, agents, committees, by whatever name or description whatsoever from taking any steps or further action towards recognizing, screening, clearing, attending to and/or considering whatsoever the 4th Defendant for the purposes of aspiring, contesting or standing for election for the office of the president of the Federal Republic of Nigeria or any election whatsoever on the platform of the 1st Defendant”.

He also sought for an injunction “compelling the PDP, its national Chairman, and the National Secretary of the PDP, Alh Abubarkar Kawu Baraje, to comply, respect and be bound by the provisions of the PDP constitution for the time being in force”.
