Anambra boundary dispute: A’Court upturns High court’s decision

ONITSHA—The Court of Appeal sitting in Enugu has upheld an appeal filed by leaders of Umuomaku community in Orumba South Local Government Area of Anambra state who are claiming that the actual boundary between them and their neighbouring Ezira community also in the Orumba South council area is at Aghomili River, as decided by the state Boundary Committee and not across the River as is being claimed by Ezira community.

In a unianimous judgement read by Justice Misitura Omodere Bolaji-Yusuff and supported by two others, Justices Tom Shaibu Yakubu and Emmanuel Akomaye Agim, the court said the appeal has merit and is hereby allowed, because the suit filed by the respondents at the state High court which ruled in their favour, was not properly constituted by due process of law.

The appellate court therefore dismissed the lower court judgement for incompetence.
