Court hears suit seeking cancellation of  Enugu PDP governorship primaries today

ENUGU—An Abuja Federal High Court, presided over by Justice Evoh Chukwu, will today commence hearing on the suit filed before it by the proprietor of Peace Mass Transit, Dr. Samuel Maduka Onyishi, a Peoples Democratic Party, PDP, governorship aspirant in Enugu State.

Onyishi is seeking the cancellation of the December 8 primaries for being in breach of Section 87(4) (b) (I) of the Electoral Act.

His prayer is for the court to, not only direct PDP to conduct a fresh governorship primaries in Enugu State, but to also grant an injunction restraining Independent National Electoral Commission, INEC, from accepting/acting upon any name whatsoever forwarded to it by PDP as the winner of the election purportedly held on December 8 or as the candidate of the party for the forthcoming governorship election in the state.

Justice Chukwu had ordered PDP and INEC not to submit or accept anyone as the governorship candidate of the party till January 14, but the industrial action by Judiciary Staff Union of Nigeria, JUSUN, stalled the hearing.

The judge had said: “I must warn that since this matter is already before this court, none of the parties should do anything capable of affecting the Res of the suit before me.

“This court will not hesitate to void any action taken by any of the parties before the next adjourned date.”

However, now that courts have resumed, observers are waiting with bathed breath whether the decision of the party to submit names to INEC ahead of the coming general election has exposed it to contempt proceedings.
