Mike Ozekhome, SAN – “The electoral Act of 2010 with the 2011 amendment is vey clear. It is an act of the National law which is still very valid as an existing law. Section 45(1) of the Act deals with postponement of elections and it makes it clear that elections into the offices of the President and Vice President, Governors and Deputy Governors, and members of the National Assembly- which are already scheduled for February 14, can be postponed by INEC on a date which should not be earlier than 150 days to the expiration of the present term of the occupants of the offices, and not latter than 30 days before the expiration.
