Senator Rafiu Adegbenga Kaka

ABEOKUTA—The Supreme Court has upheld the election that brought Senator Sefiu Adegbenga Kaka representing Ogun East Senatorial District into the National Assembly in 2011.
Kaka who ran on the platform of defunct Action Congress of Nigeria, ACN, was dragged before the court by Chief Adebisi Adegbuyi on the ground that the party did not conduct a primary election in the senatorial district in accordance with section 87 of the Electoral Act 2010(as amended).
Adegbuyi had asked the court for an order setting aside the nomination of Kaka by the party.
The All Progressives Congress, APC, substituted for ACN, Kaka and the Independent National Electoral Commission, INEC, were the first, second and third respondents in the suit respectively.
The appellant through the suit had directed the defendant to accept him as the senatorial candidate of the party.
