Appear now or go to jail, court warns HiTV boss, others

A Lagos Federal High Court presided over by Honourable Justice O. Okeke has again ordered the Managing Director of Entertainment Highway Limited,owners of sports cable channel-HITv, Mr. Toyin Subair,  to appear before him on June 14 or risk going to jail.

Justice Okeke repeated the order following the failure of the MD of the cable outfit to appear before him on June7th to defend himself against accusation of the contempt of the court.

Justice Okeke on June 4th ordered Subair and his agents to appear before him on June 7, 2010 following complaints from court bailiffs that  Subair’s agents prevented them from executing a court order issued on March 15th on the company in a Suit No. FHC/L/CS/295/2010 brought against Entertainment Highway Limited by the Musical Copyright Society Nigeria-MCSN for the infringement of its copyright.

When the matter came up on June 7th, of the six staffers of Entertainment Highway Limited expected to appear before Justice Okeke, only five appeared without Mr. Toyin Subair. This infuriated the Judge who insisted that the five would be committed to prison until June 14th when the charge of contempt of court will come up because their boss refused to appear before the court.

It took the pleadings of lawyers present in court to get the five off the hook. But the Judge ordered Mr. Subair should appear before him on June 14th or risk going to jail for contempt of the court.
