Jos – The Peoples Democratic Party (PDP) in Plateau State, yesterday, finally lost the chairmanship of Bokkos Local Government Area to the Action Congress (AC) as the Local Government Election Appeal Tribunal upheld the decision of the lower tribunal upturning the election of Mr. Moses Dongo.
Chairman of the tribunal, Justice Yargata Nimpar in an almost two hours judgement, dismissed the appeal filed by Moses Dongo as lacking merit and ordered that the certificate of return be issued to Mr. Iliya Amagon of the AC and that he be sworn-in as the duly elected chairman.
The appeal tribunal upheld the decision of the lower tribunal on the various issues and declared Amagon as the duly elected chairman of the local government.
Dongo had appealed the decision of the lower tribunal urging the upper tribunal to upturn the decision and declare him the winner of the chairmanship election.
However, the appeal tribunal in its ruling, said the appeal lacked merit and upheld the decision of the lower tribunal on the five issues presented for determination.
Chairman, Caretaker Committee of AC in the state, Chief Amos Gizo in his reaction, commended the appellate tribunal for upholding justice. “This is justice for you. Justice will always stand and we are certain we are going to get more,†he stated.
It was double jeopardy for Dongo as he was earlier in the week served with an impeachment notice by the legislative council of the local government for alleged breaches of the constitution.
It agreed that the allegation that the results for four of the 20 wards in the local government were cancelled because the election was marred by violence was not proved by the appellant as no evidence was presented to substantiate them.
