The Medan Teneke faction of the PDP in Adamawa State has taken the Murtala Nyako faction to court challenging the legality of the continuation of Kugama-led executive in office in violation of the provisions of the PDP constitution.

Joined in the suit are the Independent National Electoral Commission (INEC) and the National Chairman of the PDP, Chief Okwesilieze Nwodo.

The applicants want the Court to determine whether by the strict provisions of the PDP Constitution, a party executive committee can be validly formed without an election conducted at a congress properly summoned and held in accordance with those provisions.

Besides the plaintiffs also want the Court to decide whether the Kugama leadership of the PDP in Adamawa could have validly assumed their offices without compliance with Sections 223 of the 1999 Constitution as amended.

The plaintiffs say the present Adamawa State PDP executives were not validly elected and therefore they are occupying office illegally. They want the Court to determine whether by the provisions of the 1999 Constitution and the amended PDP Constitution, holding a congress of the Adamawa State PDP is not mandatory, at least once in every two years.
