Justice Peter Affen of the F.C.T High Court, Maitama, Abuja has dismissed the four-count criminal charge preferred against a former House of Representatives, Nze Chidi Duru by the Economic and Financial Crimes Commission, EFCC as being vexatious and abuse of court process.

In a ruling delivered by the court on the preliminary objection filed by the defendant, the court held that the charge on which Duru was brought before it had been nullified and voided by a court of competent jurisdiction.
In the Preliminary Objection filed by counsel to Nze Chidi Duru, praying the court to quash and dismiss the four counts charge filed by the EFCC, the court declared it as a brief meant to embarrass Nze Chidi Duru.
He held that the EFCC had earlier withdrew a similar charge in a Lagos High Court relevant toa the four count charge filed against Duru, which the EFCC on its own volition withdrew with a clear statement that their is nothing criminal against Nze Chidi Duru.
Nze Chidi Duru had always contended that this particular case like the other ones brought against him is simply an alleged ploy by the sacked DG of National Pension Commission and one other m to allegedly appropriate his business, First Guarantee Pension Limited in the last six years.
