Appointing indicted persons in govt is illegal, immoral – Court

OWERRI—An Imo State High Court sitting in Owerri, has declared that the appointment of persons indicted in the White Paper on Imo State University, IMSU, Owerri, into positions of authority was “illegal, immoral, null, void and of no effect.”

Justice Ngozi Opara handed down the judgment in suit by  Incorporated Trustees of Every Child Educational Advancement Foundation, against Imo Governor and Attorney General and Commi- ssioner for Justice.

The court said, “I declare that  the state governor’s appointment of persons who were indicted in the said White Paper dated June 2009 into positions of authority is unconstitutional, illegal, immoral, null, void and of no effect.”

Saying that the White Paper on IMSU was binding on the state governor, Justice Opara held “the first defendant (state governor) is duty bound to implement it.

“I make an order directing the first defendant to disengage from her services, all those indicted in the said White Paper. There shall be costs assessed at N10,000 only,” the court said.
