Sokoto—Sokoto State Judicial Division of the Court of Appeal, Wednesday, dismissed an appeal filed by Alhaji Yusha’u Ahmed, All Nigeria Peoples Party, ANPP, governorship candidate in the just concluded gubernatorial election in the state, against Governor Aliyu Wamakko.
ANPP had approached the Court of Appeal through Appeal No. CA/S/EPT/GOV/1/2012, discontented with the judgment of the Governorship Election Petition Tribunal, which struck out its Petition No. SK/EPT/GOV/1/2012 on May 2, 2012, in favour of Governor Wamakko.
Aggrieved by the tribunal’s decision, ANPP and its governorship candidate filed a Notice of Appeal premised on 11 grounds of appeal, in the process, distilling seven issues for determination by the Appeal Court in their brief of argument filed on May 28, 2012.
According to the judgment, Wamakko also distilled four issues for determination in his brief of argument filed on June 5, 2012.
The Appeal Court presided over by Justice Uwani Musa Abba Aji and unanimously concurred by Justices Jafaru Mika’ilu, Hussein Mukhtar and Abubakar Datti Yahaya, dismissed the appeal for lack of merit.
The court ruled: “Based on the foregoing appraisal and findings, this appeal is completely devoid of any merit. It is hereby dismissed. The decision of the Tribunal delivered on the May 2, 2012 striking out the Appellant’s petition is hereby affirmed.”
