Delta High court throws out suit by Oporomo

Justice Veronica Agboje of a Delta state High court in Warri has dismissed an appeal with suit  NO.: W/30/2024,  filed by  Godspower Tam Oporomo  seeking to among others quashed the judgment of a lower court on the issue.

His lordship in the judgement dismissed the appeal as lacking in merit.

It reads in part: “I have carefully considered the summary of facts in the testimonies. of the Prosecution witnesses. I have also carefully considered the Ruling of the learned trial Magistrate delivered on 18th September 2023 on the Appellant’s no case submission and it is my holding that I have no reason to fault the lower Court’s Ruling.

Therefore, on a detailed consideration of the respective case of the Appellant and the Respondent in this Appeal, the appropriate order this Court can make in this circumstance is one dismissing the Appellant’s appeal for lacking in merit.

“Accordingly, the Appellant’s appeal against the Ruling of the lower Court delivered on 18th September 2023 is dismissed. The lower Court’s Ruling of 18th September 2023 is affirmed. The Appellant is ordered to present his defence to the Charge against him at the lower Court .

“Cost of the appeal is assessed at N300,000.00 (three hundred thousand naira) against the Appellant in favour of the Respondent “.
