ABUJA – The Resource Centre for Human Rights and Civic Education (CHRICED) has condemned President Bola Ahmed Tinubu’s declaration of a state of emergency in Rivers State, warning that it threatens Nigeria’s democracy and constitutional governance.

This decision includes the suspension of Governor Siminalayi Fubara, his deputy, and the Rivers State House of Assembly, which CHRICED describes as a violation of the 1999 Constitution.

In a statement signed by Comrade Ibrahim M. Zikirullahi, Executive Director of CHRICED, the organisation noted that the President’s actions bypassed the constitutional process for removing a governor, which requires impeachment by the State House of Assembly.

The suspension of elected officials and the appointment of an administrator for six months have raised concerns about federal overreach and the erosion of democratic principles.

CHRICED expressed concerns about the political motivations behind the crisis, indicating that the handling of the situation appears biased. The declaration of a state of emergency is seen as part of a pattern of federal interference in opposition-led states, with similar tactics reportedly used in Kano State.

CHRICED called for the immediate revocation of the state of emergency and the restoration of democratic governance in Rivers State. It also urged a thorough investigation into the circumstances surrounding the crisis and accountability for all involved.

The statement reads: “CHRICED unequivocally denounces President Bola Ahmed Tinubu’s announcement of a state of emergency in Rivers State. This move undermines the rights of the citizens who elected their representatives.

“President Tinubu has contravened the 1999 Constitution by suspending Governor Siminalayi Fubara, his deputy, Mrs. Ngozi Odu, and all members of the Rivers State House of Assembly. He has appointed Vice Admiral Ibokette Ibas (Retd) as an administrator for an initial six-month period.

“While Section 305 of the 1999 Constitution allows the President to declare a state of emergency, it does not permit the suspension of an elected governor. The Constitution outlines a specific impeachment process for this purpose.

“CHRICED is concerned about the handling of the conflict in Rivers State, which appears politically motivated. Accountability must be enforced for all parties to ensure fairness and justice.

“CHRICED rejects the declaration of a state of emergency in Rivers State and urges the President to revoke it to uphold peace and stability. This action is essential for Nigeria’s economic health.

“CHRICED calls for a comprehensive investigation into the circumstances surrounding the current crisis. Any sincere effort to restore order must start with holding all responsible parties accountable—not just those deemed politically vulnerable.

“As a civil society organisation advocating for justice and the rule of law, CHRICED denounces the state of emergency in Rivers State as a challenge to the electorate and calls for the immediate restoration of democratic governance.”
