TEACHERS in the Delta State University, DELSU, Staff Secondary School, Abraka, have asked the State High Court, Isiokolo division, Delta State, to grant an interlocutory injunction restraining the Delta State Government and four other Defendants/Respondents, their servants, agents and privies from transferring them from their service and status as staff of DELSU to staff of State Model Secondary Schools in Delta State.

The prayer was made at the resumed hearing of suit No: HCI/70/2010 between M.O Eyuren, O.J Okonye, O.J Jowah, Abel Erumere and Mrs. M.O Okoegbele for themselves and on behalf of the teaching staff in DELSU Staff Secondary School, Abraka and the Delta State Government; Delta State University; the Attorney General and Commissioner for Justice, Delta State; the Commissioner for Higher Education, Delta State and the Governing Council of the Delta State University. Counsel to the teachers, Larry Ovwromoh, also prayed the court to restrain the Defendants/Respondents from doing anything or carrying out any act that would interfere with his clients’ rights, status or employment with the second defendant (Delta State University) pending the determination of the substantive suit. He averred that the entire purpose of the interlocutory injunction was to maintain status quo pending the determination of the motion on notice.

In her submission, the Deputy Director, Delta State Ministry of Justice, Barr. (Mrs.) C.E Eronmwon who appeared for the first, third and fourth Defendants/Respondents said that the Claimants/Applicants have shown that their action was speculative.

She, therefore, urged the court to dismiss the teachers’ prayer. Counsel to the second and fifth defendants/respondents (Delta State University and the Governing Council of the Delta State University), F.E Akoko in his submission, aligned himself with the position of the counsel to the first, third and fourth defendants/respondents, pleading with the court not to grant the teachers’ prayer.
