ONITSHA-All Progressives Grand Alliance, APGA, Tuesday reiterated its call on the President of the Court of Appeal to disband the election petition tribunal 2 sitting in Awka, headed by Justice Pat Onajite Kuejubola, over alleged compromise.
Addressing reporters, state secretary of the party, Mr Okoli Akirika, said APGA had to petition the Court of Appeal president because of the way the 3-man panel of justices had been handling all its matters in favour of Action Congress of Nigeria.
He said: “We have written a petition to the President of the Court of Appeal because there are issues of bias in the manner the tribunal 2 had been handling our cases. We have not been having fair hearing.”
He said the petition was based on two contradictory cases the tribunal handled between APGA and the ANC, favouring the in the same matter that was decided otherwise.
“ The president of the court of Appeal set up the tribunal and has the constitutional, legal duty to to investigate the tribunal activities especially when such serious issues are raised,” he added.
Akirika appealed to the president of the Court of Appeal to, as a matter of urgency, investigate the activities of panel 2 and disband it if it was found that the allegations raised by APGA was correct.
According to him, the decision by the party to petition was informed by a statement said to have been credited to senator Chris Ngige that ANC was in court to win all its cases.
“ That Ngige said they are in the tribunal to win all their cases has cast doubt and clout over the independence of the panel because something influenced him to say that. This means that the panel of judges have been compromised,” he said.
