ASABA  – Vice-Chairman of Oshimili North Local Government Area in Delta State, Mr. Tony Monyei, has kicked against his suspension  by members of the State House of Assembly.

He said that the House has no powers to do so, in view of a subsisting court injunction to that effect.

Sensing  that some councillors were plotting to remove him from office, Monyei had  approached a Delta State High Court sitting in Asaba, for redress.

Trial judge in the matter, Justice C.  Ogisi, had granted an order restraining the respondents “by themselves, their agents, privies and servants from impeaching or seeking to impeach the applicant, pending the determination of the motion on notice.”

Mr. Lawrence Nwadede, counsel to the embattled council Vice Chairman, who was  later suspended by the House despite the court order, had expressed disappointment over the action of the House, saying that “politicians must learn to obey court orders as that is the only way to save our democracy.”

His lawyer showed newsmen a copy of the court injunction dated 18 February 2011 and also the copy of a letter signed by the Clerk of the state House of Assembly, Mr. Raymond Yavbieri, conveying the resolution of the House suspending his client (Monyei) during the sitting of the House on 9 March 2011.

He promised to draw the attention of the court to the flagrant disregard of its (court) order.

Effort to get comments from the Clerk of the House was unsuccessful.
