LAGOS – A Lagos State High Court, yesterday, refused the application by Cadbury Nigeria Plc, to stay the execution of a judgment delivered by the court in a suit by the former Managing Director of the company, Mr Olubunmi Oni, which had declared his (Oni) sack, as wrongful.
The court struck out Cadbury’s application for want of diligent prosecution.
Justice Ayotunde Phillips, had in her judgment delivered on November 12, 2010, held that the dismissal of Oni by a letter dated December 11, 2006, and signed by Dr. Imo Itsueli, the then Chairman of Cadbury, was unlawful. She had also held that the sack was a breach of Oni’s contract of employment.
But dissatisfied with the court’s decision, Cadbury appealed against same before the Court of Appeal, Lagos and also asked the lower court, to stay execution of the judgment pending hearing and final determination of its appeal.
At the hearing of the matter, yesterday, Oni, through his counsel, urged the court to strike out the application.
