Former Governor of Edo State, Chief Lucky Igbinedion, whose two choice property were recently sealed off by the Economic and Financial Crime Commission, EFCC, yesterday, said the Federal Government deceived a Federal High Court, Lagos, to obtain the order to seal up the said property.
Head of Chambers, Rickey Tarfa, SAN, law firm, Mr Olusegun Odubela, in a statement, in Lagos, yesterday, said “Igbinedion in a motion to be argued on Monday next week before Justice M. Idris, will tell the court that the government suppressed material facts that he (Igbinedion) had already entered into plea bargain to a similar charge which terminated further trial.”
“Besides, the government did not inform the court that when the plea bargain was entered into the other time, all the parties agreed that all charges against him and other accused persons would be dropped.
“Igbinedion, therefore, has asked the Federal High Court in Lagos to set aside and/or discharge the ex-parte order made on his property, because the orders were “irregularly obtained and abuse of court process. The court has no jurisdiction to try them on the same or substantially the same charge twice.”
“Igbinedion’s request for setting aside the order of forfeiture on his property came as he has also challenged his proposed arraignment before a Federal High Court in Benin City, which he described as “double jeopardy,” the statement added.
