AWKA—AN Anambra State High Court sitting at Ihiala has ordered the National Chairman of the Peoples Democratic Party, PDP, Dr Okwesilieze Nwodo, the PDP and Hon. Chijioke Edeoga, who was the chairman of Anambra State Congress Committee of the party not to dissolve the Chief Emma Nwaeze-led state executive which was elected recently.
The court presided over by Justice P. C Nwizu, said the election was in obedience of the judgment of court in Suit N0: HIH/26/2010 and instruction of the Independent National Electoral Commission, INEC, to conduct congresses to elect executive committee and officers of PDP in Anambra State.
The former secretary of the state chapter of PDP, Prince Ken Emeakayi, had gone to court arguing that sacking or dissolving the Nwaeze state executive committee elected on October 25, 2010, without any reason or verifiable proof that the elected Nwaeze committee had committed any act against the constitution of PDP, would amount to a violation of the order of court.
The court also ordered that the Emma Nwaeze- led executive committee, having been elected and inaugurated in line with the judgment of Ihiala High Court Suit N0: H1H/26/2010, was entitled to a four-year tenure in office in accordance with the PDP constitution 2009 as amended.
It said that the Nwaeze committee would perform all the functions of the state executive committee enshrined in the constitution of the party.
The court also made a declaration that Chief Olisa Metu, the National Vice-Chairman of the party in the South East remained the leader of the South East Zonal Working Committee of PDP and shall continue to perform the functions of the office, including but not limited to supervising and coordinating the affairs and conduct of PDP which facts featured in suit N0: HIH/26/2010.
