Justice Oluwatoyin Ipaye of a Lagos High Court sitting in Igbosere, yesterday, sentenced an armed robber, Akeem Lawal, to death by hanging for attacking his stepmother with matches and shooting the stepsister.
Justice Ipaye said: “I find you guilty as charged on count one of conspiracy to rob and guilty on count two of armed robbery as charged in the amended charge.”
Before the judge handed down the sentence, she asked the convict’s counsel if she had any allocutus.
The convict’s counsel, E. B. Obogwu, in her alloctus urged the judge to temper justice with mercy as the convict has a son who is dependent on him, adding that if given another chance he won’t toe that line again.
However, Justice Ipaye held that Lawal shall be hung by the neck until he dies.
“You shall be hanged on the neck until you die, may the Lord God have mercy on your soul,” the judge held.
In her judgment, the judge held that the prosecution has been able to prove its case beyond reasonable doubt, that there was robbery, armed robbery and that the convict was one of the armed robbers that attacked the victims.
When the matter came up yesterday for judgment, Z. O. Okunowo announced her appearance for the prosecution and E. B. Obogwu announced her appearance for the convict.
In her judgment the judge held: “I have no reason to doubt the testimonies of the victims, as they were eyewitnesses and also had a close opportunity to see the robbers.
“The first witness had only one son which the prosecution has been able to establish.
“There is no doubt that the Police did not investigate the incident until after the petition was written to them about it. I am therefore satisfied that the prosecution have been able to prove its case beyond reasonable doubt,” the judge said.
