Justice Oluwatoyin Ipaye of an Ikeja High Court, yesterday, sentenced 24-year-old aluminium fabricator, Onyeka Patrick, to death by hanging for the gruesome strangulation of an 8-year-old boy, Ayuba Erikitola.
Justice Ipaye delivered the verdict on the grounds that the prosecution has proven beyond reasonable doubt the death of a human being and the act of death being caused by the intention of the accused.
Patrick, who had earlier pleaded not guilty, was convicted on a one-count charge of murder levelled against him by the Lagos State Government.
The convict committed the said offence on January 12, 2013, at plot 14, 3rd Avenue Mulmaco Estate.
According to the charge, Patrick did murder the little boy by strangling him to death and thereby committed an offence contrary to Section 221 of the Criminal Law of Lagos State, 2011.
Patrick, who lived in same neighbourhood with the deceased, had kidnapped the boy.
However, on realising that the boy might identify him as his kidnapper, he killed him and buried the body in a septic tank at an uncompleted building within the estate, and thereafter proceeded to demand N5 million ransom from the father.
