PDP appeals Tribunal judgment on Assembly poll in Edo

BENIN—EDO State  Peoples Democratic Party, PDP, and its  candidate in the April 14, 2015 state House of Assembly election for Orhionmwon South constituency II, Mr. Friday Ogierhiakhi, have appealed  the judgment of the National and State Houses of Assembly Election Tribunal, Edo State which declared Mr. Asoro Roland of All Progressives Congress, APC, winner of the election.

Respondents in the appeal are Asoro, APC, Independent National Electoral Commission, INEC and the Returning Officer for Orhionmwon South Constituency II.

The appellants,  through their counsel, Mr. Kingsley Obamogie, want the appellate court to determine whether the lower tribunal was right when it held that the respondents’ objection to the competence of ground 1 of the petition could be taken without reference to the Electoral Act, 2010 (as amended).

The appellants  also want the appellate court to determine whether or not the lower tribunal was right when it held that the applicant’s ground 1 of the petition was incompetent.
