The Court of Appeal, Lagos Division, Friday, dismissed an appeal on the matter brought by the Peoples Democratic Party (PDP) and its candidate, Mrs. Salis Ayodele against the law maker representing Lagos East Senatorial District, Senator ‘Gbenga Ashafa and his party, the All Progressives Congress.
The victory followed the July 27 dismissal of the election petition filed by the PDP and its candidate after the National Assembly elections earlier this year.
Salis Ayodele and the PDP had argued that the judgement of the lower tribunal was erroneous on the grounds that the tribunal erred on many issues in arriving at the decision to dismiss the petition. The PDP also questioned the qualification of the chairman of the tribunal stating that he was not qualified to sit on the case.
In the final judgement read yesterday by Muhammad Danjuma (JCA), the judgment dismissed the appeal and stated that there was no evidence presented to show cause that the tribunal chairman was not qualified to hold the office.
