Police arraign Babangida Aliyu for alleged theft

The police on Monday arraigned a 30-year-old electrician, Babangida Aliyu, in an Abuja Senior Magistrates’ Court for allegedly stealing an air-conditioner belonging to one Alhaji Ibrahim Bello.

The Prosecutor, Mr David Udeh, told the court that the accused was reported to the Wuse police station on April 16, by Bello of No 7, Koforidua St., Wuse Zone 2, Abuja .

Udeh said the accused, and others, now at large, jointly stole the complainant’s Samsung air-conditioner valued at N40,000.

The prosecutor said that the offence contravened the provisions of sections 79 and 288 of the Penal Code.

Section 79 of the Penal Code says “when a criminal act is done by several persons in furtherance of the common intention of all, each of such persons is liable for that act in the same manner as if it were done by him alone.

Section 288 states that “whoever commits theft in or from any building, tent or vessel, which building, tent or vessel is used as a human dwelling or used for the custody of property, shall be punished with imprisonment for a term which may extend to seven years or with fine or with both.

However, the accused denied the allegation, saying he is not guilty of the offence.

The Magistrate, Mr Aliyu Shafa, granted the accused bail in the sum of N100,000 with a surety in like sum, who must be resident within the court’s jurisdiction.

He adjourned the case to May 16 for further hearing. (NAN)
