An Ikeka High Court, Lagos, yesterday, dismissed an application by Deji Abiola, son of the acclaimed winner of the June 12, 1993 presidential election, late Chief M.K.O. Abiola, asking the court to quash the charge of stealing against him.

Trial judge, Justice Adeniyi Onigbanjo, meanwhile adjourned till May 7, for trial to commence in the one-count charge against him by Economic and Financial Crimes Commission, EFCC.

Refusing the application, the judge said the complainant had the prosecutorial power to charge the applicant, contrary to his claim, adding that there was sufficient evidence to prosecute the case.

Deji was arraigned by EFCC on June 30, 2011 on allegation of collecting N35.5million from Mr. Jide Jose, under the pretext of helping him import printing machines from Switzerland.

Deji had, through his counsel, asked the court  to quash the charge against him, contending that the complainant had no prosecutorial power to file the charge against him, as the charge of stealing was a state offence that cannot be prosecuted by the commission.
