The Court of Appeal sitting in Benin, Edo State, has nullified the election of the member representing Oshimili North in Delta State House of Assembly, Mr. Pat Mozie.
The appellate court also ordered the Accord Party candidate in the election, Princess Pat Ajudua to be declared winner, while the certificate of return be handed to her for immediate swearing in as the duly elected winner of the state House of Assembly seat for Oshimili North Constituency.
It will be recalled that the Governorship and House of Assembly Election Petition Panel sitting in Asaba had earlier in its judgment ordered a re-run election to be conducted in some wards of the local government area, which was inconclusive.
Ajudua had challenged the decision of the Election Petition Panel in Asaba and sought for her to be declared winner, having scored the highest votes in that election in the remaining wards, where election was held in the council.
….Affirms Daubry’s victory
The legal battle between Mr. Kennedy Daubry, member of Delta State House of Assembly representing Burutu Constituency II, and Mr. Kennedy Orubebe, candidate of the opposition Democratic People’s Party, DPP, over the April 26 State Assembly election has been finally put to rest.
Mr. Daubry of the ruling People’s Democratic Party, PDP, had on Monday triumphed over Mr. Kennedy Orubebe, as the Appeal Court sitting in Benin set aside the lower Tribunal’s ruling.
The Appeal Court in its ruling affirmed the victory of Daubry in the April 26, Burutu Constituency II election.
