Tribunal upholds PDP candidate’s election in Igueben

BENIN—National/ State Election Petitions Tribunal sitting in Benin, yesterday, upheld the election of Mr. Kingsley Ehigiamusoe of Peoples Democratic Party, PDP, representing Igueben Constituency in the state House of Assembly as the winner of the April 24 election.

Mr. Stephen Idehen of Action Congress of Nigeria, ACN, had in a petition, alleged that the re-run election of April 28 in Ward 6 Unit 1 and Ward 8 Unit 3 were fraught with irregularities.

He alleged that the said re-run was characterised by ballot-box stuffing and accreditation of under-aged voters, urging the tribunal to nullify Ehigiamusoe’s election and declare him as winner.

, having won the election conducted on April 26, April, 2011.

Ehigiamusoe, had, while praying the tribunal to dismiss the petition, argued that the re-run election of April 28, was valid as it was in consonance with the provisions of the Electoral Act and the Election Manual of Independent National Electoral Commission, INEC.

The tribunal held the petitioner failed to prove his case beyond reasonable doubt.

“We, hereby, uphold the election of the first respondent and refuse to grant any of the reliefs sought by the petitioner and therefore, dismiss his petition for lack of merit,” the tribunal said.
