PDP, Braimoh sue ACN over Edo North senatorial ticket

…ask court to sack Obende over alleged certificate forgery

ABUJA – The Peoples Democratic Party, PDP, and its candidate in the April 9 senatorial election in Edo North, Senator Yisa Braimoh, has sued  Action Congress of Nigeria, ACN, and  winner of the poll, Senator Domingo Obende, before a Federal High Court in Abuja, alleging certificate forgery.

In an originating summons filed before the High Court on Friday, the plaintiffs alleged that the 1st defendant, Senator Obende, used a forged First School Leaving Certificate to secure Form CF001 from the Independent National Electoral Commission, INEC.

Consequently, they have posed 8-legal questions for the determination of the court, among which were, “whether the 1st defendant is not liable to automatically vacate his seat as a member of Senate representing Edo North senatorial district in the Senate of the National Assembly

“Should the court find that the 1st defendant lied/misrepresented facts in Form CF001 he submitted to the 3rd defendant, INEC, whether same would not a fortiori invalidate his purported results at the polls on 9th April 2011?

“Whether the 1st plaintiff, Braimoh, should not be declared as the senator representing Edo North senatorial district by the 3rd defendant, regarding the fact that the 2nd defendant did not present a qualified candidate for the April 9, 2011, senatorial elections in Edo State.”

Equally listed as defendants in the suit were the Clerk of the National Assembly,  Senate and Inspector General of Police.

Beside, the plaintiffs are praying the High Court for 16 principal reliefs, including, “an order of this honourable court directing the 3rd defendant to withdraw/cancel forthwith the Certificate of Return issued to the 1st defendant.

“An order declaring the 1st plaintiff as the senator representing Edo North senatorial district in the National Assembly, having scored the highest valid votes out of all the qualified (candidates) that contested the election.

“An order of the court directing the 3rd defendant to give to the 1st plaintiff forthwith, a Certificate of Return as the senator representing Edo North senatorial district in the Senate, having contested the April 9, 2011, election and scored the second highest votes (65, 264); and an order directing the 4th and 5th defendants to, forthwith, swear the 1st plaintiff as the senator representing Edo North senatorial district.”
