Okota royal house seeks case retrial

Alhaji Lateef Adisa Aregbe, head of Okota, Lagos Royal House, and five others have sought relief from the Court of Appeal to set aside the judgment of a lower court and an order remitting the case back to Lagos High Court for retrial before another judge.

A motion on notice has been filed by Aregbe, who was attacked at his residence few years ago, at a Lagos High Court to grant him leave with the five others who are appealing against the judgment of October 25, 2010.
Yemi Ogundele, Aregbe’s lawyer said, in an affidavit, that the first claimant is the head of the Okota Royal Family of Isolo, Lagos while others are the executive members of the  royal house.

According to the lawyer, the claimant did not agree with the ruling of the court of last October in the case: Alhaji Chief Kolawole Agbabiaka vs Alhaji Lateef Adisa Aregbe and five others.

The lawyer quoted Aregbe as saying that when the defendants initiated settlement on the issues in dispute, he clearly reiterated his position that “the interest of the family must be adequately protected and secured by any amicable solution.”

He said that the grounds of appeal was that the “learned trial judge erred in law on the issue of consent judgment in the matter when in actual fact he did not agree to the terms of settlement and did not sign or consent to same.”
