ABUJA — A dissatisfied member of the Peoples Democratic Party, PDP, Mr. Cyriacus Njoku, yesterday, asked an Abuja High court sitting in Maitama to go ahead and sack members of the National Executive Committee, NWC, of the party.
The plaintiff is pleading the court to dissolve the highest body of the ruling party on the grounds that it was constituted in total violation of the PDP constitution and section 223(1)(a) 1999 Constitution of Nigeria.
He is equally praying the high court to invoke its jurisdiction and set aside all the decisions and resolutions taken and passed by the PDP NWC since March 8, 2008.
Specifically, the plaintiff in the process he filed through his lawyer, Mr. Ugochukwu Osuagwu, is asking for an order setting aside the 45th– 55th meetings of the PDP NWC.
He equally wants the court to determine whether Article 12.71(b)(c)(d)(e)(f)(g)(r)(u) of the constitution of the party upon which the members of the present National Executive Committee of the party was constituted is legal and binding having regard to Section 223(1)(a) of the Constitution of the Federal Republic of Nigeria, 1999.
Furthermore, the court is to determine whether the meeting held by the National Executive Committee of the party held from March 8, 2008 till date in violation of Section 223(1)(a) of the Constitution of the Federal Republic of Nigeria, 1999 is not a nullity and of no consequence whatsoever.
In the nine-paragraph affidavit deposed to by the plaintiff, he contended that two-third of the NWC were never elected by the party at her last National Convention on March 8, 2008 or at any other forum, adding that this was contrary to Section 223(1)(a) of the 1999 constitution.
