ABAKALIKI — THE National Judicial Council, NJC, has initiated an inquiry to establish the facts behind the suit filed by the State Chairman, Progressive Peoples Alliance, PPA, in Ebonyi State, Hon. Cyril Obazi, over the timely amendment of the Electoral Act 2006 by the State House of Assembly some days to the last local government election conducted in the state.
This suit is suffering a delay since it was filed on July 5, 2010, at the State High Court, Abakaliki.
Vanguard gathered that the Chairman, NJC, Justice A.I. Katsina-Alu had given two weeks ultimatum to Ebonyi State Chief Judge to reply the council over the said suit.
Confirming the development, Obazi said the party was earnestly waiting to hear from the Chairman, NJC, Justice A. I Katsina-Alu on the next line of action, if hearing on the suit remained delayed by the court.
According Obazi, the last local government election in the state should be nullified as having been conducted outside the ambit of the constitution.
He said: “We pray the court to nullify the last local government election in the state. How can the PDP-led government amend the constitution just some days to election? This is very wrong and we are determined to tell the world the truth behind the intrigues of the election.
“I am confident in the court process. PPA believes in the rule of law and by it we stand. We challenge them to come to court. The truth is bound to come out.”
Vanguard learnt that the suit, No HAB/42/2010, is seeking legal interpretation of relevant sections of the constitution guiding the Electoral Act 2006 in the conduct of local government election.
